PEM America, Inc. (“PEM America,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit pemamerica.com (the “Website”), contact us, or otherwise interact with us through the Website.

By using the Website, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Website.

hCaptcha

The Website uses hCaptcha to help distinguish human users from automated activity and protect our contact form from spam and abuse. hCaptcha may collect technical and interaction data needed to provide this security service. 4. How We Disclose Information

We may disclose information in the following circumstances:

These providers are authorized to process information only for the services they provide to us, subject to applicable contractual and legal requirements.
  • Legal and safety purposes: We may disclose information when we believe disclosure is required by law or is reasonably necessary to comply with legal process, enforce our rights, investigate misconduct, prevent harm, or protect the safety and security of PEM America or others.
  • Business transactions: Information may be disclosed as part of a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar corporate transaction, subject to appropriate protections.
  • With your direction or consent: We may disclose information for another purpose when you direct us to do so or provide consent.

We do not sell personal information for money. We also do not knowingly share personal information for cross-context behavioral advertising. If our practices change, we will update this Privacy Policy and provide any privacy choices required by applicable law.

5. Global Privacy Control, Do Not Track, and Privacy Choices

Some browsers and extensions allow you to send an opt-out preference signal, such as Global Privacy Control (“GPC”). Where required by applicable law, we treat a recognized GPC signal as a request to opt out of the sale or sharing of personal information associated with that browser or device.

Some browsers also offer a “Do Not Track” (“DNT”) signal, which is separate and distinct from GPC. As required by the California Online Privacy Protection Act (CalOPPA), we disclose how we respond to browser DNT signals: the Website currently does not respond to DNT signals in a manner different from the GPC signal described above, and no uniform industry or legal standard for recognizing DNT signals currently exists. We will update this disclosure if our practices regarding DNT signals change.

You may also use the Website’s cookie or privacy controls to manage eligible data-collection preferences. Because these choices may be stored through a browser cookie, you may need to renew your selection if you clear your cookies or use another browser or device.

Where required by applicable law, we honor recognized universal opt-out preference signals (including GPC) as valid requests to opt out of the sale, sharing, or use of personal information for targeted advertising, in the manner required by each applicable state law.

6. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including responding to inquiries, maintaining business records, protecting the Website, resolving disputes, enforcing agreements, and satisfying legal, accounting, or reporting requirements.

The table in Section 9 below sets out, for each category of personal information we collect, the retention period or the criteria used to determine that period, as required by the CPRA regulations (11 CCR §§ 7011–7012). Retention periods may vary depending on the nature of the information, why it was collected, and applicable legal requirements. We may retain aggregated or de-identified information that does not reasonably identify you.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have rights concerning your personal information, including the right to:

  • Confirm whether we process your personal information
  • Request access to or a copy of your personal information
  • Request correction of inaccurate personal information
  • Request deletion of personal information
  • Obtain certain information in a portable format
  • Opt out of certain sales, sharing, targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects
  • Appeal our response to a privacy request, where applicable
  • Receive equal service and not be discriminated against for exercising a privacy right

To submit a request, email legal@pemamerica.com. Please include enough information for us to understand and respond to your request. We may need to verify your identity before completing it. If you use an authorized agent, we may request evidence of the agent’s authority and take reasonable steps to verify the request.

We will respond within 45 days of receipt of a verifiable request. Where reasonably necessary, we may extend this period by an additional 45 days (90 days total), in which case we will notify you of the extension and the reason for the delay within the first 45-day period. These rights are not absolute, and we may deny or limit a request when permitted by law.

9. California Privacy Notice

This section supplements the rest of this Privacy Policy for California residents. In the preceding 12 months, we may have collected the following categories of personal information:

We may disclose these categories to the service providers described in Section 4 for business purposes. We do not knowingly collect sensitive personal information through the Website, and we do not use or disclose sensitive personal information for purposes that require a right to limit under California law.

We do not sell personal information for money and do not knowingly sell or share the personal information of consumers under 16 years of age. California residents may exercise applicable rights as described in Section 8.  Any collection is limited to what is reasonably necessary for the disclosed purposes set forth herein, if any.

California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) permits California residents to request certain information regarding our disclosure, if any, of personal information to third parties for those third parties’ own direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes. If this practice changes, we will provide California residents with the disclosure or opt-out mechanism required under Section 1798.83. 10. Children’s Privacy

The Website is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Website. If you believe a child has provided us with personal information, please contact us so we can review and, when appropriate, delete it.

11. Third-Party Websites

The Website may contain links to websites or services operated by other organizations. We are not responsible for the privacy, security, content, or practices of those third parties. We encourage you to review their privacy policies before providing information to them.

12. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technologies, legal requirements, or other circumstances. When we make changes, we will revise the “Last Updated” date at the top of this page. If required by law, we will provide additional notice or obtain consent.
